Terms and Conditions of Use for "Aleph" Website

Welcome to the "Aleph" website (hereinafter: "the Website"). The Website is operated and managed by Shiran Yitzhari, licensed business no. 301308219 (hereinafter: "the Seller" or "the Website Owner").

Use of the Website, including purchasing products through it, is subject to the terms detailed in these Terms and Conditions. Browsing the Website and/or making a purchase through it constitutes full and unconditional agreement to all the terms of use detailed below.

1. General Terms

  • The Website serves as a platform for displaying, marketing, and selling handmade ceramic items, designed and produced by the Seller.
  • Every product on the Website is handmade, therefore there may be natural differences between product images and the actual product.
  • Images on the Website are for illustration purposes only, and the Seller is not responsible for minor differences between the displayed product and the final product.
  • The Seller reserves the right to update the terms and conditions, product prices, delivery times, and shipping conditions at any time without prior notice.
  • In case of conflict between what is stated in these Terms and Conditions and any other publication on the Website or in any media, these Terms and Conditions shall prevail.
  • Eligibility to use the Website is for anyone who is 18 years old and has an active bank account or valid credit card and has an email inbox whose address will be provided when purchasing on the Website. A minor who performs actions will be considered a minor who has received permission from their parents/guardians to make the purchase on the Website.

2. Orders on the Website

  • Orders can be placed on the Website at any time, as long as the product is available in stock.
  • The customer must enter accurate and complete details when placing an order, including full name, accurate address, phone number, and valid email address.
  • Order confirmation sent to the customer by email after payment constitutes confirmation that the order has been received, but does not obligate the Seller to supply the product in case of out-of-stock or technical error.
  • If a product is out of stock, notice will be given to the customer within 3 business days, and the transaction will be canceled or an alternative will be offered – at the customer's choice.
  • The Seller reserves the right to cancel an order in case of error in price, error in product description, or in case of suspected misuse of the Website.

3. Prices and Payments

  • All prices on the Website include VAT as required by law (unless otherwise stated).
  • Payment will be made through the payment methods available on the Website (credit card, Bit, PayPal, or bank transfer – depending on what is available).
  • The Seller may update product prices at any time without prior notice. The binding price is the price as it appears at the time of completing the order.
  • In case of typographical error or technical malfunction in price display – the Seller is not obligated to supply the product at the incorrect price and will notify the customer accordingly.

4. Shipping and Self-Pickup

  • Product delivery is carried out through Israel Post service.
  • Estimated delivery time is 7 to 14 business days from the date of order confirmation and actual payment.
  • Delays in delivery may occur due to congestion, delays in postal service, or circumstances beyond the Seller's control.
  • The Seller is not responsible for delays, damage, or loss of shipments caused by Israel Post service.
  • Shipping fees will be calculated and displayed when placing the order and will be added to the total price of the products.
  • Self-pickup will be possible only by prior arrangement, at a location and time to be determined by the Seller.

5. Cancellations, Returns, and Exchanges

  • Transaction cancellation will be carried out in accordance with the provisions of the Consumer Protection Law, 1981.
  • A transaction can be canceled within 14 days from the actual date of receiving the product, by written notice to email: shiranyitz@gmail.com.
  • Cancellation or return will be possible only for products that have not been used, have not been damaged, and are in their original packaging.
  • Products manufactured according to customer's personal customization cannot be returned or canceled.
  • In case of a defect in the product or error in delivery – the Seller will bear the return costs.
  • In any other case of cancellation, shipping and return fees will be charged to the customer.
  • Refund will be given within 7 business days from the date of receiving the product back, to the same payment method used for the order.
  • Breakage or defect caused by improper use – will not be considered a product defect and will not be eligible for refund or exchange.

6. Warranty and Product Use

  • Ceramic items on the Website are handmade and therefore natural differences may appear between units.
  • Product warranty will apply to reasonable use according to the usage instructions provided with the product (such as suitability for dishwasher, oven, or microwave, if explicitly stated).
  • The Seller will not be liable for damage caused by use contrary to instructions or due to accident, dropping, or improper handling of the product.
  • The Seller is not responsible for consequential or indirect damage caused by use of the product.

7. Privacy and Information Security

  • Personal information provided by customers on the Website will be kept in a secure business database and will be used only for order processing, customer service, and deliveries.
  • The Seller undertakes to maintain information confidentiality and not to transfer it to third parties, unless required by law or for the purpose of providing the service.
  • The Website uses accepted security measures to protect personal information, but absolute protection against hacking or unauthorized access cannot be guaranteed.
  • By using the Website, the customer confirms the privacy policy and the use of information according to these terms.

8. Intellectual Property

  • All copyrights, trademarks, designs, photographs, texts, logo, videos, graphics, as well as the design and display of the entire Website – are the exclusive property of Shiran Yitzhari, business 301308219.
  • All ceramic items, models, shapes, decorations, colors, design ideas, and concepts displayed on the Website are the fruit of the Seller's original creation and are in her exclusive ownership.
  • It is forbidden to copy, duplicate, photograph, reproduce, manufacture, market, sell, publish, display, or distribute any product, image, design, or design idea of the Seller – whether in whole or in part – by any means and in any way, without obtaining explicit prior written permission from the Seller.
  • The prohibition includes, among other things:
    • Manufacturing ceramic items identical or similar to the products displayed on the Website;
    • Use of the Website's images or content for commercial, promotional, or marketing purposes;
    • Selling products that imitate the Seller's designs, including on social networks, fairs, or e-commerce sites.
  • Every ceramic item design on the Website is considered an "artistic creation" as defined in the Copyright Law, 2007, and any use of it without permission constitutes copyright infringement and/or unfair competition under the Commercial Torts Law, 1999.
  • The Seller reserves the right to take all legal measures, including legal action, in case of violation of her rights.
  • Displaying products on the Website does not constitute granting any license or authorization to use the Seller's intellectual property rights.
  • All rights not explicitly granted to the customer – are reserved to the Seller only.

9. Limitation of Liability

  • The Seller is not responsible for technical malfunctions on the Website, delays in shipments beyond her control, or any indirect damage caused by use of the Website or products.
  • The Seller will not be liable for consequential damage, loss of income, distress, or any other indirect damage, and her maximum liability will not exceed the amount actually paid for the product.
  • Use of the Website is at the user's own responsibility.

10. Law and Jurisdiction

  • These Terms and Conditions shall be governed by the laws of the State of Israel only.
  • Exclusive jurisdiction to hear any dispute relating to these Terms and Conditions or use of the Website shall be vested in the competent courts in the city of Haifa only.
